Neighborhood Sports Club Field Access Waiver
Release of liability, assumption of risk, and indemnity agreement · Version 1.1 · July 25, 2026
In exchange for being permitted to enter and use the facilities, fields, courts, and equipment of Neighborhood Sports Club ("NSC"), located at 100 2nd St, Oakland, CA 94607, and to participate in soccer and other athletic or recreational activities offered there (together, the "Activities"), I agree to the following:
1. Acknowledgment of risks. I understand that the Activities are physical, fast moving, and involve contact with other people, walls, boards, nets, goals, balls, and playing surfaces. Risks include, but are not limited to: sprains, strains, broken bones, concussions and other head injuries, cuts, bruises, torn ligaments, dental injuries, heat illness, cardiac events, paralysis, and death; collisions with other participants, spectators, or fixed objects; slips and falls; defects or conditions of the premises or equipment; weather conditions; and the actions or negligence of other participants, spectators, referees, and staff. I understand these risks cannot be eliminated even when reasonable care is used.
2. Voluntary participation and assumption of risk. I am participating voluntarily. I knowingly and freely assume all risks of the Activities and of being present at NSC, both known and unknown, including risks arising from the ordinary negligence of the Released Parties (defined below), and I accept full responsibility for my participation.
3. Health representation. I represent that I am in adequate physical condition to participate, that I have no medical condition that would make participation unsafe, and that it is my responsibility to consult a physician if I have any doubt. I agree to stop participating and notify staff if I notice any unusual symptom or hazard.
4. Release and waiver of liability. To the fullest extent permitted by California law, I release, waive, and discharge Neighborhood Sports Club and its owners, officers, members, managers, employees, contractors, coaches, referees, volunteers, agents, landlords, sponsors, and insurers (the "Released Parties") from any and all claims, demands, causes of action, damages, losses, costs, and expenses of any kind, including attorney fees, arising out of or related to my presence at NSC or my participation in the Activities, including claims based on the ordinary negligence of the Released Parties. This release does not extend to claims arising from gross negligence, willful misconduct, or any liability that cannot be waived as a matter of law.
5. Waiver of California Civil Code Section 1542. I expressly waive all rights under Section 1542 of the California Civil Code, which states: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."
6. Indemnification. I agree to indemnify, defend, and hold harmless the Released Parties from any claim, loss, or liability, including attorney fees, arising out of my conduct at NSC, my participation in the Activities, or, if I am signing for a minor, the minor's presence or participation, including claims brought by the minor or on the minor's behalf.
7. Medical treatment. I authorize the Released Parties to obtain or provide emergency medical care for me, or for the minor I am signing for, if in their judgment it is needed, and I agree that I am responsible for all costs of that care. I understand NSC does not carry medical insurance covering participants.
8. Rules and conduct. I agree to follow NSC's posted rules and staff instructions. NSC may refuse entry or remove any person at its discretion. I am responsible for damage I cause to the facility or equipment beyond normal wear.
9. Personal property. NSC is not responsible for lost, stolen, or damaged personal property.
10. Parent or guardian agreement for minors. If I am registering one or more participants under 18 years of age, I represent that I am the minor's parent or legal guardian with full authority to sign this agreement on the minor's behalf. I make every agreement in this document for myself and on behalf of each minor listed in my registration, including the assumption of risk, release, Section 1542 waiver, indemnity, and medical authorization. I agree to indemnify the Released Parties against any claim brought by or on behalf of the minor arising out of the minor's presence at NSC or participation in the Activities, including claims the minor may bring after reaching the age of majority to the extent permitted by law.
11. Term. This agreement applies to every visit to NSC and every session of the Activities, now and in the future, until I revoke it in writing to NSC, and revocation has no effect on anything that happened before NSC receives it.
12. Electronic signature. I consent to signing this agreement electronically. Typing my full legal name and checking the agreement box constitutes my signature, with the same force as a handwritten signature. I can request a paper copy of this agreement from NSC at any time.
13. General. This agreement is governed by California law. If any part is held unenforceable, the rest remains in full effect. This is the entire agreement between me and NSC about its subject and replaces any earlier waiver I have signed with NSC. I have read this agreement, I understand it, and I know I am giving up substantial legal rights, including the right to sue, by signing it.
